Furthermore, the state’s code deems commercial gambling (operating a non-authorized gambling operation with the intent of making a profit) a nonperson felony of severity level 8.

While these laws don’t specifically mention online poker or offshore sites, they can extend to them by default. However, things can be left to interpretation. Poker is not merely a game “dependent upon chance,” and while offshore poker sites are conducting “commercial gambling,” they are doing so outside of the country and, therefore, don’t have to abide by Kansas laws.
